William Shakespeares Sonnet 18 is justifiably  considered one of the most beautiful  verses  in the English language. The  sonnet’s  enduring power comes from  Shakespeare’s  ability to capture the essence of love so clearly and succinctly. After much debate among  scholars, it is now generally accepted that the subject of the poem is male. In 1640, a publisher named  John Benson released a highly inaccurate edition of Shakespeare’s sonnets in which he edited out the young man, replacing â€Å"he† with â€Å"she.† Benson’s revision was considered the standard text until 1780 when Edmond Malone returned to the 1609  quarto and re-edited the poems. Scholars soon realized that the first 126 sonnets were originally addressed to a young man, sparking debates about Shakespeare’s sexuality. The nature of the relationship between the two men is highly ambiguous and it is often impossible to tell if Shakespeare is describing platonic or erotic love. Summary Sonnet 18 is perhaps the most famous of the 154 sonnets Shakespeare completed in his lifetime (not including the six he included in several of his plays). The poem was originally published, along with Shakespeares other sonnets, in a quarto in 1609. Scholars have identified three subjects in this collection of poems—the Rival Poet, the Dark Lady, and an anonymous young man known as the Fair Youth. Sonnet 18 is addressed to the latter. The poem opens with the immortal line Shall I compare thee to a summers day? following which Shakespeare does just that, finding the youths beauty even more lovely and more temperate that that of summer. Here Shakespeare is at his most romantic, writing that  love and the youth’s beauty are more permanent than a summer’s day, which is tainted by occasional winds, blistering heat, and the eventual change of season. While summer must always come to an end, the speaker’s love for the man is eternal—and the youths eternal summer shall not fade. The young man to whom the poem is addressed is the muse for Shakespeare’s first 126 sonnets. Although there is some debate about the correct ordering of the texts, the first 126 sonnets are thematically interlinked and demonstrate a progressive narrative. They tell of a romantic affair that becomes more passionate and intense with each sonnet. In the  previous 17  sonnets, the poet has been trying to convince the young man to settle down and have children, but in Sonnet 18 the speaker abandons this domesticity for the first time and accepts love’s all-consuming passion—a theme that appears again in the sonnets that follow. Major Themes Sonnet 18 touches on a few simple themes: Love The speaker begins by comparing the man’s beauty to summer, but soon the man becomes a force of nature himself. In the line  Ã¢â‚¬Å"thy eternal summer shall not fade,† the man suddenly embodies summer. As a perfect being, he is even powerful than the summer’s day to which he has been compared up to this point. In this way, Shakespeare suggests that love is an even more powerful force than nature. Writing and Memory Like many other sonnets, Sonnet 18 contains a volta, or turn, where the subject matter changes and the speaker shifts from describing the subjects beauty to describing what will happen after the youth eventually grows old and dies. Nor shall Death brag thou wanderst in his shade, Shakespeare writes. Instead, he says that the fair youth will live on through the poem itself, which has captured the young mans beauty: So long as men can breathe or eyes can see, / So long lives this, and this gives life to thee. Literary Style Sonnet 18 is an English or Elizabethan sonnet, meaning it contains 14 lines, including three quatrains and a couplet, and is written in iambic pentameter. The poem follows the rhyme scheme  abab cdcd efef gg. Like many sonnets of the era, the poem takes the form of a direct address to an unnamed subject. The volta occurs at the beginning of the third quatrain, where the poet turns his attention to the future—But thy eternal summer shall not fade. The key literary device in the poem is metaphor, which Shakespeare references directly in the opening line. However, instead of using it traditionally—comparing the subject to a summers day—Shakespeare draws attention to all the ways in which the comparison is inadequate. Historical Context Little is known about the composition of Shakespeares sonnets and how much of the material in them is autobiographical. In The Contents of the Dead Mans Pockets by Jack Finney, Tom also faced a psychological conflict. The story was mainly focused on his physical conflict, but near the end he experienced psychological conflict. As with Leiningen, Tom faced the choice to die or to live, and he realized with that conflict how much his wife meant to him. He overcame the conflict when, as we read, the yellow paper flew out the window again, but he left to be with his wife. In Blues Aint No Mockinbird by Toni Cade Bambara, Granny experienced a psychological conflict with her past treatment and her current conflict with Smiley and Camera. She struggled to break and maybe actually kill them or fall into depression, but she was successful in winning the conflict. When she hummed in a high pitch instead of low, it showed that she had finally won. In conclusion, psychological conflicts are important. They can be very dangerous because we are fighting within ourselves and our rational reasoning. And when we fight within ourself it is hard to win. Antigone: Beliefs, Opinions, and Moral Views Essay

Antigone and Creon, from â€Å"Antigone† by Sophocles, encounter a philosophical war based on their moral views. A conflict arose when the principles that backed up their actions disagreed with each other. Antigone’s side of the conflict held a gods’ law is the way approach, as opposed to the â€Å"I am king† approach Creon chose to follow. The variation in the beliefs, opinions, and moral views of Antigone and Creon were constantly disputed through out the play. Antigone felt that Creon was disregarding the laws of gods through his law. After she was captured and brought to Creon, she told him, â€Å"Your edict, King was strong, but all your strength is weakness itself against the immortal unrecorded laws of God. They are not merely now: they were, and shall be, operative for ever, beyond man utterly.† Antigone’s opinion is one that supports the Gods and the laws of heaven. Her view is set by her belief that if someone is not given a proper burial, then that person would not be accepted into heaven. Antigone was a very religious person, and acceptance of her brother by the Gods was very important to her. She felt that â€Å"†¦I will bury him; and if I must die, I say that this crime is holy: I shall lie down with him in death, and I shall be as dear to him as he to me.† Creon’s order was personal to Antigone, as she saw his law as invading her family life as well as offensive to the Gods. In Antigone’s eyes, Creon betrayed the laws of the Gods by not allowing her to properly bury her brother, Polynices. She believed that the burial was a sacred ritual, and Creon did not have the authority to refuse Polynices his entitlement. Antigone’s strong belief towards the burial of her brother is what led her to her death by the hands of Creon. Since Creon was ruler, whatever he said was the law, and since Antigone broke his law, Creon was in a sense to blame, because if that law wasn’t put into effect then Antigone wouldn’t have hung herself. Nevertheless, she did not stop defending what she thought was proper. Right before her death, Antigone exclaimed, â€Å"†¦ you see me now, the last unhappy daughter of a line of kings, your kings, led away to death. You will remember what things I suffer and at what men’s hands, because I would not  transgress the laws of heaven.† She feels that Creon is abusing his power as king and dealing with her task on a personal level. Creon’s actions were based off of the fact that, â€Å"†¦ no ruler can expect complete loyalty from his subjects until he has been tested in office.† Polynices’ body left unburied is a symbol of Creon’s action to achieve the loyalty that he desired. â€Å"As long as I am King, no traitor is going to be honored with the loyal man.† Leaving the body unburied was done to show respect for Thebes, not in spite of the family. After all, how could the ruler of a kingdom honor a man who attempted to invade and conquer what is now his kingdom. This was far from the beliefs of Antigone. She believed that everyone deserved the right to have a proper burial, no matter what wrong doing that person may have done, and that the gods’ are the authorities that judge the afterlife. Due to this belief, Creon turned Antigone into his prisoner, and not the public’s. The general population actually supported Antigone, but though they were too scared to stand against Creon. Haimon knew of this and told his father, â€Å"Died so shameful a death for a generous act: ‘She covered her brother’s body. Is this indecent? She kept him from dogs and vultures. Is this a crime? Death? – She should have all the honor that we can give her!’ This is the way they talk out there in the city.† Creon was exercising complete domination of political power. By not allowing Antigone to perform her religious ceremony of burying her brother is interfering with religious affairs. This act denied Antigone of her religious freedom. Creon had to weigh each factor carefully, and had to decide between his morals and his beliefs. He was torn, trying to choose what was just. â€Å"†¦ Oh it is hard to give in! But it is worse to risk everything for stubborn pride.† The conflict of beliefs was what led to Antigone’s, Haimon’s, and Megareus’ death. Both sides were just, but Creon was forced to decide and determine right from wrong when there was no clear answer. In the end, the Chorus’ opinion was the determining factor and they convinced Creon to set Antigone free, but it was already too late. The conflict between the beliefs of Creon and Antigone are layered throughout the play. Both have logical arguments, but neither dominates the other. Antigone is motivated by her strong religious feelings, while Creon is trying to be lawful and do what’s right for his kingdom. Neither won this battle, as Antigone took her life, the lives of Creon’s wife and son followed, leaving Creon with nothing but his precious kingdom.

Stevenson, a steamer ticket was bought by the plaintiff where the destination it was written on the front side and on the back side, certain terms including the liability of loss, injury or damages were mentioned. There was no indication on the front side to refer the back of the ticket for terms and the plaintiff travelled without seeing the back of the ticket. The luggage of the claimant was lost during the journey because of the mistake of employees of the company. The court found the harm to the plaintiff should be recovered from the defendant despite the exemption clause mentioned in the ticket (Henderson v. Stevenson [1875]). Unenforceable nature of the standard form contracts The contractual dispute resolution clause may be unenforceable in the legal system as it seems to be an agreement to agree. In WTE Co-generation and Visy Energy Pty Limited v RCR Energy Pty Limited Anor, there was a provision of dispute resolution in the contract mentioning that the senior executives would attempt to resolve the differences. The court held that the clause of the dispute resolution is the agreement to agree, which is not enforceable at law (WTE Co-generation and Visy Energy Pty Limited v RCR Energy Pty Limited Anor, [2013]). Incorporation of unfair terms The common law stated that at the time of signing the contract, the term of the adhesion contract is to be brought to the notice of the contracting party. The terms of the contract would not be said to be accepted by the party unless they know the provision. Therefore, the term would not be a part of the agreement (AkbÄÂ ±yÄÂ ±klÄÂ ±, Dikmen and Eaton 2012). In Olley v Marlborough Court, the claimant books a hotel room. In the reception desk, the plaintiff signed the contract where any elimination clause was not mentioned. A note was given at the back of the door in the hotel room. In the notice, it was mentioned that the hotel proprietors exclude their liability in case of any damage or loss of the property of the boarders. The court held that the notice referred to in back door is not effective as the contract is already signed by the parties before the claimant saw the notice. The notice in the back of the gate did not form the part of the notice (Olley v Marlboroug h Court, [1949]). Fundamental breach of contract In case one term of the standard forms contract resulted in the basic breach of contract, then such term must be removed from the standard forms contract so that the weaker among the parties be protected. If a party has high bargaining power, then the party tries to insert the exemption clause in the contract that the duty for the performance of the contractual obligation is harmful (Cakmak and Tas 2014). In Alexander v. Railway Executive, the claimant received a ticket in return of his deposition of luggage in the cloak room of defendant. The ticket has a printed term about the exemption of liability of the defendants in the case of any loss or misdelivery of luggage. The luggage of the plaintiff was delivered to an unauthorised person without producing the ticket. The court held that there was a fundamental breach of the contract as of non-delivery of the luggage to the plaintiff. The defendants held liable for the damages to the claimant (Alexander v. Railway Executive [1951]). Liability in tort In case there is a general exemption clause mentioning the exclusion of all obligations in the contract, still the liability for tort will not be excluded. In White v. John Warwick Co Ltd, the defendant, gave the cycle on hire basis to the plaintiff. The defendant settled in the agreement to maintain the cycle in the working condition. The agreement contains a clause that the respondent would not be liable for any personal injury. While travelling in the cycle, the load of the cycle tilted forward and the claimant fall from the cycle and injury occurred. The court held that though the exemption clause mentioned in the agreement, the defendant is liable for their negligence for which the plaintiff got an injury. (White v. John Warwick Co Ltd [1953]) Liability towards the third party The common law of contract stated that contract is an agreement signed by two parties signed it, no third party or any party other than who signed the agreement has any liability to fulfill the contract. However, in certain cases, the third party is liable for the terms of the standard forms of contract (Mzyece et al. 2012). In Morris v. CW Martin Sons, the furrier got the fur garment to clean from the plaintiff. As the furrier was not into the business of cleaning the fur garment, the plaintiff consented to give the garment to the defendant for cleaning. The plaintiff filed a case against the defendant as the fur garments were stolen by the servant of the respondent. The defendant claimed that he should be exempted from the liability as there was no contract signed by the plaintiff and him. The court held the defendant liable for the lost and said that he was not allowed any exemption (Morris v. CW Martin Sons [1966]). Standard forms of Construction Contracts The International Federation of Consulting Engineers (FIDIC), New Engineering Contract (NEC) and Joint Contracts Tribunal (JCT) mostly issue the forms of construction contracts used in England. In some cases, the obligation on construction and design are upon the constructor. There are other organizations, which publish standard forms of contracts used on the construction projects like the Institution of Civil Engineers (ICE) and the Institute of Chemical Engineers (IChemE) (Yoke-Lian et al. 2012). FIDIC The FIDIC forms used three types of design and construction that mainly vary in the assigning dependability for designing the works and in the allotment of risk: The Red Book It is the Conditions of Contract for Construction for Building and Engineering Works Design by the Employer, and also known as the Construction Contract. The Yellow Book Conditions of Contract for Plant and Design Build for Electrical and Mechanical Plant, and for Building and Engineering Works Designed by the Contractor, also known as the Plant and Design-Build Contract; and (c) The Silver Book Conditions of Contract for Engineering, Procurement and Construction/Turnkey Projects, also known as the EPC/Turnkey Contract. FIDIC also publishes the White Book Consultant Model Services Agreement, which is a commonly used standard form for consultant services (Taggart, Koskela and Rooke 2012). NEC The NEC 3 Engineering and Construction Contract (NEC 3 ECC) implements a diverse advancement in the terminology, formation, and contracting the viewpoint to the customary forms, like the FIDIC forms. The NEC 3 adopts a mutual course focusing on the involvement of the party and contract administration. There is another standard form published by the NEC known as the NEC 3 Professional Services Contract. The form implements same collaborative contracting philosophy (Oluwole, Razak and Oluwole 2012). JCT The standard forms contract issued by the Joint Contracts Tribunal (JCT) is the common forms of the contract of building in the real estate of the UK for the construction projects. The standard forms of sub-contract and the collateral warranty also published by the JCT for the use of the construction projects in England. A broad variety of the construction contracts publishes by the JCT in England. The JCT prints standard forms based on the character of the construction projects, the contemplation of particular procurement route, and the calculation of payment for the work done and paid to the contractor (Holt 2013). The JCT standard forms of contracts consist of the typical forms specially made for: Traditional procurement The task for the design of the project and the construction are reserved different, where the employer selected team created the project and accordingly the separately appointed constructors construct the building. Design and build procurement The requirement of the employer is meet by the constructor who is responsible for both designing and constructing the building. Construction management The employer engages a professional team, which is accountable for work design and monitor the work management, some trade contractors with different work packages and manager of construction for administering and managing the trade contracts separately for the company. The consultancy agreements perhaps exercise by the consultants or developers. However, the model forms of industry of the consultant agreement issued by several qualified bodies are often used by some projects. Specifically, the model forms of industry are regarded as consultant-friendly, and bespoke forms are utilised by the developers and preferred by funders (Feinman 2015). Conclusion The standard form contracts are uniform contracts, which contains huge terms and conditions printed and limits or eliminates the liability under the contract. By the standard forms, the large companies got the opportunities to abuse the weak point of the individual. The giant companies imposed the terms on individual look like private legislation can extend to exemption of liability under the contract. When the matter takes to the courts, it is found very difficult to rescue the weaker party. For this reason, certain rules made by the courts have for protection of the interest of the customer, passenger or the consumer to whom any exemption clause of the standard form contracts imposed.
